The Supreme Court of India has reiterated that sex workers are entitled to live with dignity under the Constitution and directed authorities to ensure that their fundamental rights are protected. A bench led by Justice L. Nageswara Rao heard petitions related to the rights, rehabilitation, and treatment of sex workers by police authorities and issued a series of important guidelines.
During the hearing, the court observed that there is a clear distinction between individuals who voluntarily choose sex work and victims trapped in human trafficking networks.
The bench stated that if an adult woman is engaged in sex work of her own free will, the police should not harass her, detain her at police stations, or register criminal cases against her.
The Supreme Court also warned police officials against revealing the identities of sex workers during rescue operations.
The court directed that photographs and videos of such operations should not be shared with the media, noting that exposing their identities violates their dignity and privacy. Media organisations, television channels, and newspapers were also instructed not to publish photographs or personal details of victims.
Aadhaar Cards Without Address Proof
In another significant direction, the Supreme Court ordered both Central and State governments to issue Aadhaar cards to sex workers even if they do not possess valid address proof. The court observed that the lack of identity documents often prevents them from accessing healthcare, banking services, and government welfare schemes.
At the same time, the court made it clear that there should be zero tolerance towards human trafficking. It directed governments to take strict action against trafficking mafias that force women and children into prostitution. The bench also stressed the need for proper rehabilitation measures and support systems for victims rescued from trafficking networks.
